A Supreme Court lawyer has filed a writ petition in the High Court seeking a review or cancellation of the electricity contract with India's Adani Group. The writ challenges the validity of the electricity agreement between the Bangladesh government and Adani (Jharkhand) Limited, which became effective on November 5, 2017. The petition was filed in public interest by Barrister M. Abdul Kaiyum. Earlier, on November 6, the lawyer had sent a legal notice to the PDB Chairman and the Energy Secretary, urging them to review or cancel the one-sided electricity contract with Adani Group within three days.
In the writ petition, Abdul Kaiyum notes that many experts have opined that under this agreement, Bangladesh will pay significantly higher prices for electricity generated using low-grade coal compared to other coal-based power plants. Coal from an Adani-owned mine in Australia will be supplied to an Adani port in India, and this coal will be sent to the Godda power plant in India at Bangladesh's expense.
The writ petition, citing a report from Al Jazeera, claims that the BPDB has essentially entered into an electricity purchase agreement under which Adani will import coal from Australia to India, and Bangladesh will bear the entire cost.
The Supreme Court lawyer further states in the petition that it is unimaginable how the BPDB could have entered into such a one-sided agreement without the involvement of relevant officials.
